Supreme Court Upholds Indian Child Welfare Act

In a significant ruling on June 15, 2023, the Supreme Court of the United States opted to leave the Indian Child Welfare Act (ICWA) intact. This decision marks a crucial moment for tribal sovereignty and the well-being of Native American children and families across the nation.

The Indian Child Welfare Act, enacted in 1978, was a direct response to the alarmingly high rates of Native American children being removed from their homes by state child welfare agencies and placed with non-Native families.
