Supreme Court Upholds Indian Child Welfare Act

In a significant ruling on June 15, 2023, the Supreme Court of the United States opted to leave the Indian Child Welfare Act (ICWA) intact. This decision marks a crucial moment for tribal sovereignty and the well-being of Native American children and families across the nation.

The Indian Child Welfare Act, enacted in 1978, was a direct response to the alarmingly high rates of Native American children being removed from their homes by state child welfare agencies and placed with non-Native families. This practice often disregarded tribal ties and cultural heritage, leading to a profound loss of identity and connection for these children and their communities. ICWA established minimum federal standards for the removal and placement of Native American children in state court foster care and adoption proceedings, prioritizing placements with family members, other tribal members, or other Native American families.

It safeguards the ability of tribal governments to exercise their inherent authority over their children and families, preventing further erosion of their sovereignty.
